Differences of opinion between the courts of the Member States about the validity of Community actions could jeopardize the unity of the Community's legal system itself and threaten the fundamental need for legal certainty.That is the reason for the primacy of Community law. It is not presumptuousness , it is not arrogance , it is an absolute necessity. That is why it is no wonder that the President of the European Court of Justice , Mr Rodriguez Iglesias , is talking about an attack on the basic elements of the Community's constitution in this context. I very much hope that the national constitutional courts will recognise that in accordance with article 164 it is the task of the European Court of Justice to ensure the law in interpreting and applying this treaty. To ensure , that is the wording , to ensure. No national constitutional court can set itself up as ruling over Community law
Das ist nicht Anmaßung , das ist nicht Überheblichkeit , das ist eine absolut zwingende Notwendigkeit. Deshalb nimmt es nicht Wunder , daß der Präsident des Europäischen Gerichtshofs , Rodrigez Iglesias , in diesem Zusammenhang von einem Angriff auf die Grundelemente der Gemeinschaftsverfassung spricht. Ich hoffe sehr , daß die nationalen Verfassungsgerichte erkennen , daß der Europäische Gerichtshof nach Artikel 164 die Wahrung des Rechts bei der Auslegung und Anwendung dieses Vertrages zu sichern hat. Zu sichern , das ist der Wortlaut , zu sichern. Kein nationales Verfassungsgericht kann sich zum Herrn des Gemeinschaftsrechts aufspielen. Kein Verfassungsgericht kann der Tutor sein.Übrigens ist damit auch eine Kontrolle der nationalen Parlamente verbunden , denn sie entscheiden ja , welche Kompetenzen weiterhin übertragen werden können. Ich hoffe sehr , daß uns eine Situation erspart bleibt , nämlich daß es zu einem Vertragsverletzungsverfahren gegen einen Mitgliedstaat wegen einer Entscheidung eines Verfassungsgerichts kommt. Das möge uns bitte erspart bleiben. Insofern ist das Problem allein dadurch nicht gelöst
