Madam President , before I begin I should like to say that I come here as the rapporteur on this report at second reading. I took it over at the beginning of this Parliament , a lot of the work on it having already been done by a colleague of mine , Claude Delcroix. Before I go on to talk about it , I should just like to express my thanks for the work that was done by Mr Delcroix in the last Parliament and say that a great deal of the work that I offer you today and that Parliament has done was achieved under his guidance. We owe him a debt of gratitude.We have in front of us a directive up for a third revision , it having been thought necessary to review it in the light of experience , technical progress and operating knowledge. We should not underestimate just how important this directive is. Far too often many of the installations which this directive is designed to safeguard , operate quietly and unobtrusively without people realizing the great dangers that they pose
Frau Präsidentin. Zunächst möchte ich bemerken , daß ich als Berichterstatter für diesen Bericht in der zweiten Lesung fungiere. Ich habe ihn zu Beginn der Wahlperiode dieses Parlaments übernommen , und ein Großteil der Arbeit daran wurde bereits von meinem Kollegen Claude Delcroix geleistet. Bevor ich mich weiter darüber äußere , möchte ich erst noch Herrn Delcroix für die von ihm während der letzten Wahlperiode des Parlaments geleistete Arbeit danken und sagen , daß ein Großteil dessen , was ich Ihnen heute vorlege und was das Parlament geleistet hat , unter seiner Federführung erreicht wurde. Ich denke , dafür schulden wir ihm Dank.Vor uns liegt eine Richtlinie , die zum dritten Mal geändert werden soll , da es als notwendig erachtet wurde , sie aufgrund der Erfahrungen , des technischen Fortschritts und des bei der Anwendung erworbenen Wissens zu überarbeiten. Wir sollten die Bedeutung dieser Richtlinie keinesfalls unterschätzen. Allzu oft arbeiten viele der Anlagen , die durch diese Richtlinie sicherer gemacht werden sollen , einwandfrei und unauffällig , ohne daß sich die Menschen der großen Gefahren bewußt sind , die von ihnen ausgehen
A French firm should certainly be able to manufacture radios in south - east Asia , but the health of the female employees there is just as important as that of a female employee in the first world. The trouble is the neo - liberal project of free movement of free capital forces third world and threshold countries in particular into a horrendous competition to attract the investment with maximum tax exemption , the worst job protection and the lowest wages. We have long since known that low wage costs are not the critical factor for the majority of industrial relocations. But some people clearly think they can not only conquer new markets , but profit unobtrusively from disgraceful conditions and cover up the operation.This is precisely why global players need binding rules . Voluntary codes of conduct will not do. It is our responsibility to get our firms to make a commitment. European companies which duck European standards abroad must be excluded from all EU grants. Bonuses for starvation wages and environmental pollution. That is ironic to say the least. In view of this we would also ask for support for our amendments. The Sainjon report is long since overdue , because the OECD negotiated a multilateral investment agreement ages ago which tackles national agreements and political influence
Doch das neoliberale Projekt der freien Fahrt für freies Kapital zwingt vor allem Drittwelt - und Schwellenländer in eine horrende Standortkonkurrenz um die größte Steuerbefreiung , den schlechtesten Arbeitsschutz und die miesesten Löhne. Dabei wissen wir doch längst , daß niedrige Lohnkosten für das Gros der Betriebsverlagerungen nicht ausschlaggebend sind. Aber Unternehmer glauben offenbar , sie könnten nicht nur neue Märkte erobern , sondern in einem Aufwasch auch noch unbehelligt aus menschenunwürdigen Bedingungen Profit schlagen.Genau deswegen brauchen global players verbindliche Spielregeln. Freiwillige codes of conduct reichen nicht. Es ist unsere Aufgabe , unsere Firmen in die Pflicht zu nehmen. Hiesige Unternehmen , die auswärts europäische Standards unterlaufen , müssen von allen EU - Subventionen ausgeschlossen werden. Prämien für Hungerlöhne und Umweltverschmutzung , das ist mehr als zynisch. In diesem Sinne bitten wir auch um Unterstützung für unsere Änderungsanträge. Der Bericht Sainjon ist längst überfällig , denn längst wird in der OECD ein multilaterales Investitionsabkommen ausgehandelt , das staatliche Regelungen und politische Einflußnahme aushebelt.Wir werden natürlich morgen dafür stimmen , daß über den Bericht abgestimmt wird. Wir hatten eine sehr gute Anhörung dazu. Wir haben ausführlich diskutiert. Zu Frau Plooij van Gorsel kann ich nur einen Satz aus dem Fußballspiel sagen : Knapp daneben ist auch vorbei. Auf alle Fälle handelt es sich meiner Auffassung nach um einen interessanten Bericht , für den ich stimmen werde
Secondly , the money gained from the criminal acts is so great that it cannot be used up unobtrusively by private individuals. At conferences I always explain it as follows : organised criminals simply cannot eat , drink and be merry to a sufficient degree to get rid of the money inconspicuously. That is why they try to disguise the money acquired by criminal means and to pass it off as money which has ostensibly been acquired legally. This is called money laundering. Dirty money is turned into respectable money. Anyone who prevents this from happening , or at least makes it considerably more difficult , cuts organised crime to the quick , stunts its growth and damages its ability to propagate itself.Mr Lehne referred to the fact that we already had a directive on this very early on which harmonised standards in the European Union. Nevertheless , this new directive is necessary to allow more recent developments to be taken into account. We think it is good that the directive is not just being extended to banks but also to other businesses or professions which might be abused for money laundering purposes , and here the problems associated with the liberal professions have been satisfactorily resolved in our view. We also think it is good that all forms of organised crime , and not only drug trafficking , are to be regarded as predicate offences.We have attached particular importance to the inclusion of dealers in precious stones , dealers in luxury goods with a value in excess of EUR 50 000 and auctioneers. What surprised us rather was the fact that the Commission did not - although the problem is obvious - integrate electronic money into the directive from the word go. It would seem that the aggressive civil service intelligentsia within the Commission , who put a positive spin on anything to do with the Internet , drown out any critical murmurings about it also being possible to abuse this technology for other purposes
Zweitens , die aus kriminellen Handlungen gewonnene Geldmenge ist so groß , daß sie privat unauffällig nicht verbraucht werden kann. Ich sage das in Versammlungen immer so : Die organisierte Kriminalität kann überhaupt nicht so viel fressen , saufen und sonst was tun , als daß sie das Geld unauffällig los wird. Deshalb wird versucht , das kriminell erworbene Geld verschleiert , als scheinbar legal erworbenes Geld vorzutäuschen. Das nennt man Geldwäsche. Man macht aus schmutzigem Geld ehrbares Geld. Wer dies unterbindet oder zumindest erheblich erschwert , trifft die organisierte Kriminalität ins Mark , verhindert ihr Aufwachsen , beschädigt ihre Fortpflanzungsfähigkeit.Der Kollege Lehne hat darauf hingewiesen , daß wir schon sehr früh eine Richtlinie dazu gehabt haben , die die Standards in der Europäischen Union harmonisiert hat. Trotzdem ist diese Novelle notwendig , damit neueren Entwicklungen Rechnung getragen wird. Wir finden es gut , daß die Richtlinie nicht nur auf Banken ausgedehnt wird , sondern auch auf andere Branchen oder Berufe , die man zur Geldwäsche mißbrauchen kann , wobei die mit den freien Berufen zusammenhängenden Probleme aus unserer Sicht befriedigend gelöst werden konnten. Wir finden es auch gut , daß als Vortaten nicht nur der Drogenhandel gilt , sondern alle Formen der organisierten Kriminalität.Wir haben besonderen Wert darauf gelegt , daß die Edelsteinhändler , die Händler von Luxusgütern mit einem Wert von über 50.000 Euro und die Versteigerer miteinbezogen werden. Was uns etwas gewundert hat , ist , daß die Kommission - obwohl das Problem auf der Hand liegt - das elektronische Geld von Anfang an nicht in die Richtlinie eingebunden hat. Anscheinend verhindert die aggressive Beamtenintelligenz innerhalb der Kommission , die alles , was mit Internet zu tun hat , als positiv darstellen will , die leisesten kritischen Anmerkungen , daß man diese Technologie auch zu anderen Zwecken mißbrauchen kann.Enttäuscht hat uns der Rat : Er hat bisher überhaupt nichts entschieden , er verhält sich wie ein Ochse , der Eier legen soll. Ich sage deshalb an die Adresse des Rates : Entscheiden Sie jetzt schnell. Die Geldwäsche ist viel zu ernst , als daß man sie den Indianerspielen kleinkarierter nationaler Ministerialräte überlassen könnte
