Mr President , I cannot hope to be as brief as the rapporteur who quite rightly proposed that you approve the Council's common position. In fact , in line with the House's opinion during the first reading , the common position approves the Commission proposal without any amendments of substance. I welcome this since the final adoption of this proposal , which is now possible , will eventually guarantee identical treatment for watercolours , pastels and gouache drawings throughout the Union in the context of the return of cultural objects which were unlawfully removed from the territory of a Member State
Herr Präsident , ich kann mich schwerlich kürzer fassen als der Berichterstatter , welcher Ihnen sehr zu Recht vorschlägt , dem Gemeinsamen Standpunkt des Rates zuzustimmen. Wie bereits anläßlich des Gutachtens des Parlaments bei der ersten Lesung übernimmt der Gemeinsame Standpunkt den Vorschlag der Kommission ohne grundsätzliche Änderungen , und das freut mich , denn die endgültige Verabschiedung dieses Vorschlags , die nun möglich ist , wird in Zukunft im Zusammenhang mit der Rückerstattung von Kulturgütern , die unrechtmäßig aus dem Hoheitsgebiet eines Mitgliedsstaates verbracht wurden , die Gleichbehandlung der Gouachen , Pastellen und Aquarellen in der gesamten Union gewährleisten
Mr President , the general principle of the free movement of goods within the Union was the subject of certain appropriate restrictions on art objects described by Member States as forming part of their national treasure and heritage. A list of cultural objects was produced which , above a certain financial limit fixed for each one , required authorization in order to be exported or , in accordance with the directive we are examining , should be returned to the Member State if they had been unlawfully removed from it.However this list proved controversial as far as some cultural objects were concerned - watercolours , pastels and gouache drawings - which in some countries were regarded as drawings , with a certain financial sum , and in others were regarded as paintings , with a different financial sum. Therefore the solution that was agreed - and unanimously approved - was the establishment of an intermediate category for these objects which was slightly higher than that for drawings and a lot lower than that for paintings.Approved by the European Parliament it was subsequently adopted by the Council , without any amendments to the substance of the proposal in its common position. However the Council did make two amendments to the Commission proposal : one concerning the procedure and the other of a technical nature. The first one concerned the fact that , in order to guarantee the simultaneous entry into force of this proposal and the other one amending the regulation on the exporting of cultural objects , since there are two interdependent texts - the regulation and the directive - with a joint annex , it was suggested that the six - month period laid down for the incorporation of the directive into national law should commence from the date of publication rather than the date of adoption
Herr Präsident , der Grundsatz der Freizügigkeit der Güter und Waren in der Union hat im Hinblick auf die Kunstwerke , die von den Mitgliedsstaaten als Teil ihres kulturellen Erbes und des Volksvermögens eingestuft wurden , die angemessenen Einschränkungen erfahren. So wurde eine Katalogisierung der Kulturgüter vorgenommen , für die in Abhängigkeit von der jeweils festgesetzten Wertgrenze eine Genehmigung für die Ausfuhr erforderlich ist bzw. die - gemäß der vorliegenden Richtlinie - an die Mitgliedsstaaten zurückzuerstatten sind , sofern sie illegal verbracht worden waren.Dieser Katalog bringt jedoch im Hinblick auf bestimmte Kulturgüter - Aquarelle , Pastelle und Gouachen - Konflikte mit sich , da diese in manchen Ländern als Zeichnungen angesehen wurden , denen ein bestimmter Wert zugeordnet ist , in anderen Ländern dagegen zu den Gemälden gerechnet wurden , für die ein anderer Wert zutreffend ist. Deshalb hat man sich auf einen - allseits gebilligten - Kompromiß geeinigt , der in der Schaffung einer Zwischenkategorie für diese Güter bestand , die etwas oberhalb der Zeichnungen und weit unterhalb der Gemälde einzustufen sind.Dieser Vorschlag wurde zunächst durch das Europäische Parlament einstimmig in erster Lesung und anschließend durch den Rat in seinem Gemeinsamen Standpunkt ohne grundsätzliche Änderungen angenommen. Jedoch brachte der Rat zwei Änderungen in den Vorschlag der Kommission ein : eine Änderung hinsichtlich des Verfahrens und eine zweite Änderung technischer Natur. Die erste bestand darin , daß die Frist für die Übernahme der Richtlinie vom Tage ihrer Veröffentlichung an gerechnet werden sollte , und nicht von der Verabschiedung an ; damit sollte das gleichzeitige Inkrafttreten dieses Vorschlags und des Vorschlags , mit dem die Richtlinie über die Ausfuhr von Kulturgütern abgeändert wird , gewährleistet werden , da beide Texte - die Verordnung und die Richtlinie - miteinander in Beziehung stehen und einen gemeinsamen Anhang haben
