| It then intervened to impose a rushed timetable , marked in particular by an extraordinary meeting of the Committee on Legal Affairs and Citizens Rights - a six hour meeting held in Strasbourg on 17 November. Lastly , it intervened to correct - literally - the report by the Committee on Legal Affairs and Citizens Rights in an exceptional meeting held here last Wednesday at 8 p.m. I might add that several meetings of the secretaries - general have been given over to this report.Why such urgency. Why such attention. Why such concern amongst the group chairmen. Because , ladies and gentlemen , it was absolutely essential that a text be drawn up at all costs , no matter what its contents , before the Vienna summit. Because the ball had to be thrown back into the Council's court to hide our own inability to change the current system for reimbursing travel expenses - a system quite rightly criticised because it is shocking - and to make the Council take responsibility for the status quo .This is what we are being asked to do , and we are doing it by flouting rules , by applying a Treaty which has not been ratified and by adding to texts of the highest legal level. We are doing it by failing to exercise our future powers. A proper statute should cover the different requirements which apply to Members. A proper statute should not only address financial matters , of course , but also incompatibilities , privileges and allowances , and rules of conduct. A proper statute should provide a legal basis - which currently does not exist - for the system for reimbursing expenses and paying allowances for the exercise of office , and should also give this system the transparency it is sorely lacking.Such was the aim of the draft Statute that we tabled in Amendment No 106. In place of this , the draft from the Committee on Legal Affairs and Citizens Rights is a collection of incoherent , outrageous and ridiculous measures. The incoherency arises from stating , in recital A , that any difference in the Statute for Members on grounds of nationality shall be prohibited , yet it also refers to national systems when these are more beneficial. The outrage lies in mentioning the need to avoid difficult personal situations and to preserve already acquired rights , or those being acquired , by implementing a transitional system and a dual scale for salaries. No one is forcing Members to stand again and , ladies and gentlemen of the Socialist or Social - Democrat Groups , as you claim to be , you are simply trying to obtain something which is denied to employees in companies in your respective countries. Lastly , the ridiculous nature of this statute lies in stating that the parliamentary allowance will be paid in advance , to prepare for any eventuality | November in Straßburg besonders hervorsticht , und um schließlich in einer Sondersitzung , die am letzten Mittwoch um 20.15 Uhr in diesem Haus stattfand , den Bericht des Rechtsausschusses buchstäblich zu korrigieren. Außerdem mußten sich die Generalsekretäre in mehreren Sitzungen mit diesem Bericht befassen.Warum diese Hast. Warum all diese Mühe. Warum derartige Besorgnisse bei den Fraktionsvorsitzenden. Weil , liebe Kolleginnen und Kollegen , bis zum Gipfel von Wien um jeden Preis unbedingt ein Text welchen Inhalts auch immer hermußte , weil der Rat den Ball zurückbekommen und unsere Unfähigkeit vertuscht werden sollte , die derzeitige Reisekostenerstattungsregelung zu ändern , die zu Recht kritisiert wird , weil sie skandalös ist , und dem Rat damit die Verantwortung für den Status quo zugeschoben werden sollte.Das also wird uns abverlangt , und dabei verletzt man Rechtsvorschriften und bringt einen Vertrag in Anwendung , der nicht einmal ratifiziert ist , nimmt Ergänzungen in juristisch ausgefeilte Rechtstexte auf und mißachtet unsere künftigen Befugnisse. In ein wirkliches Statut gehören verschiedene die Abgeordneten betreffenden Bestimmungen. In ein wirkliches Statut gehören natürlich nicht nur finanzielle Fragen , sondern auch Unvereinbarkeiten , Vorrechte , Befreiungen und Verhaltensregeln. In ein wirkliches Statut gehört eine derzeit noch nicht vorhandene Rechtsgrundlage für die Kostenerstattung und Entschädigungszahlung im Zusammenhang mit der Ausübung unseres Mandats , wobei dafür wieder die Transparenz hergestellt werden muß , an der es bislang so sehr fehlt.Dies war Sinn und Zweck des Entwurfs eines Statuts , den wir im Änderungsantrag 106 vorgelegt haben. Stattdessen enthält der Entwurf des Rechtsausschusses ein Sammelsurium zusammenhangloser , skandalöser , lächerlicher Bestimmungen. Zusammenhanglos deshalb , weil im Erwägungsgrund A erklärt wird , daß jede Diskriminierung im Statut für die Abgeordneten aus Gründen der Staatsangehörigkeit verboten ist , zugleich aber auf die nationalen Regelungen Bezug genommen wird , sobald diese sich als günstiger erweisen. Skandalös , weil die Notwendigkeit betont wird , persönliche Härtefälle zu vermeiden und die erworbenen oder in Erwerb befindlichen Rechte der Abgeordneten zu wahren , wobei eine Übergangsregelung , ein doppeltes Einkommen eingeführt wird. Niemand zwingt die Abgeordneten , erneut zu kandidieren , und Sie , verehrte sozialistische oder sozialdemokratische Abgeordnete , die sich als solche verstehen , fordern für Abgeordnete etwas , das sie den Beschäftigten in Unternehmen Ihrer jeweiligen Länder verwehren. Lächerlich deshalb , weil für alle Eventualfälle darauf hingewiesen wird , daß die parlamentarische Vergütung im voraus zu zahlen ist. Üblicherweise ist es so , daß auf die Arbeit der gebührende Lohn folgt , hier dagegen kommt erst die Vergütung , dann die Arbeit.Mit solch einem Statut läßt sich das Image des Parlaments wohl nicht wahren. Nie zuvor habe ich erlebt , daß in so peinlicher Weise nationale Gefühle zur Schau gestellt wurden , daß man so krampfhaft bemüht war , sich persönliche Vorteile zu sichern , nie zuvor war mir so klar geworden , wie sehr das Europäische Parlament sich von den Sorgen der Öffentlichkeit entfernt hat. Vermutlich kann kein einziges Mitglied dieses Hauses von sich behaupten , es sei ausnahmslos mit allen Aspekten der Vorschläge von Herrn Rothley einverstanden , und gerade deshalb glaube ich , daß er seine Sache gut gemacht hat |
