The Council is therefore making decisions and , apparently , deftly transferring the responsibility for these to Parliament s Committee on the Environment. This is very interesting. We had a rather confused debate in the Committee on the Environment , Public Health and Consumer Policy and we are having this debate here today. The Council claims that , as soon as we wanted to make amendments , it distanced itself and went down another route , in league with the Commission. It even says in its decision that it believes that the Commission has another proposal to make which will circumvent Parliament and lead the Commission and Council to decide on their own. All this appears in the document which I have here.We clearly need an explanation because you could say that the debate on my report is pointless if the Council is allowed to decide what it wants
Der Rat faßt also Beschlüsse und , wie es aussieht , wälzt er die Verantwortung dafür auf elegante Weise auf den Umweltausschuß unseres Parlaments ab. Dies ist sehr interessant. Wir hatten im Ausschuß für Umweltfragen , Volksgesundheit und Verbraucherschutz eine etwas konfuse Debatte , und nun halten wir hier im Plenum unsere Debatte ab. Der Rat will , falls wir Änderungsanträge einbringen , auf Distanz gehen , in heimlichem Einverständnis mit der Kommission eine andere Richtung einschlagen. In seinem Beschluß steht sogar , seines Wissens wolle ihm die Kommission einen anderen Vorschlag unterbreiten , der das Parlament ausschaltet und der Kommission und dem Rat die Entscheidung allein überläßt. All dies steht in dem Dokument , das ich hier vor mir liegen habe.Frau Präsidentin , wir benötigen in der Tat einige Erklärungen , denn letztlich hat die Debatte über meinen Bericht vielleicht überhaupt keinen Sinn , wenn man dem Rat zugesteht , daß er beschließen kann , was er will
Mr President , the Council should realise that it is heading for a great row if it carries on as in its complex package of 27 December , making legal definitions of who is a terrorist without any democratic scrutiny. I predict that the Council's next step will be to institute Europe - wide bans. It would be outrageous to do that in secret and without accountability.Turning to the framework decisions on combating terrorism and the European arrest warrant , my group will support them. For a normally sensible British journalist yesterday to say that Europe blindly , on the nod , is about to indulge in its own sinister overreach , really is over the top.My group will not vote to postpone the entry into force of the European arrest warrant until there are common minimum standards of procedural law. Urgent action to catch terrorists and criminals cannot be postponed , but the habeas corpus amendment drafted so deftly by Mr MacCormick is very worthwhile
Herr Präsident , dem Rat sollte klar sein , dass er auf eine harte Konfrontation zusteuert , wenn er weiterhin so verfährt , wie dies bei seinem komplizierten Paket vom 27. Ich sehe schon kommen , dass der Rat als Nächstes europaweite Verbote einführen wird. Es wäre ungeheuerlich , dies hinter verschlossenen Türen und ohne Einhaltung der Rechenschaftspflicht zu tun.Meine Fraktion wird die Rahmenbeschlüsse zur Terrorismusbekämpfung und über den Europäischen Haftbefehl unterstützen. Es geht nun wirklich zu weit , wenn ein ansonsten vernünftiger britischer Journalist gestern sagte , Europa sei gerade dabei , sich blindlings zu übernehmen.Meine Fraktion wird nicht unterstützen , dass das Inkrafttreten des Europäischen Haftbefehls aufgeschoben wird , bis gemeinsame Mindeststandards für das Verfahrensrecht vorliegen. Dringend erforderliche Maßnahmen zur Verhaftung von Terroristen und Kriminellen können nicht aufgeschoben werden , aber der Habeas - Corpus - Änderungsantrag , den Herr MacCormick so geschickt formuliert hat , ist sehr nützlich
Mr President , we welcome this report so deftly piloted through Parliament by Mrs Wallis because , in the brave new world of e - commerce , there is going to be the same share of crooks and mountebanks as in the non - digital environment. For this reason consumer protection matters at least as much. It comes in two forms. First , it provides legal protection , and , secondly , it provides a means of enforcing that protection. Clearly , especially as regards small claims across international borders - in other words , between different legal systems - conventional court systems will be of limited real help , as Mrs Wallis has just pointed out.Hence we welcome this initiative to create a user - friendly , extra - judicial network across Europe. Indeed we believe it should go beyond the physical limits of the Union since the Net is no respecter of national boundaries. As is so often the case , the devil lies in the detail. We look forward to seeing that detail and wish its progress well. One of my greatest concerns about this initiative is its funding , both substantively and in terms of its publicity
Herr Präsident , wir begrüßen diesen Bericht , der von Frau Wallis mit kluger Hand durch das Parlament gesteuert wird , da es in der schönen neuen Welt des elektronischen Geschäftsverkehrs ebenso viele Gauner und Scharlatane geben wird , wie im nichtdigitalen Bereich. Aus diesem Grund ist die Bedeutung des Verbraucherschutzes in diesem Bereich mindestens ebenso groß. Er tritt in zwei Formen auf. Erstens in Form rechtlichen Schutzes , zweitens als Mittel zur Durchsetzung dieses Schutzes. Zweifellos können herkömmliche Gerichtssysteme , besonders bei grenzüberschreitenden Bagatellsachen - wenn also unterschiedliche Rechtssysteme im Spiel sind - , nur begrenzt Hilfe leisten , wie es Frau Wallis schon angedeutet hat.Daher begrüßen wir diese Initiative zur Schaffung eines nutzerfreundlichen , außergerichtlichen gesamteuropäischen Netzes. Wir sind sogar der Meinung , dass es über die physischen Grenzen der Union hinausgehen muss , weil das Internet keine Rücksicht auf die einzelstaatlichen Grenzen nimmt. Der Teufel liegt wie so oft auch hier im Detail. Wir freuen uns schon darauf , diese Details kennenzulernen und hoffen auf eine positive Entwicklung. Am meisten interessiert mich bei dieser Initiative die Finanzierung , und zwar zum einen in rein materieller Hinsicht und zum anderen in Bezug auf die Bekanntmachung der neuen Möglichkeiten für die Bürger
