In other words , we will have to avoid the legal coexistence of the euro and the national currencies. So it will be preferable for the euro to be the only legal tender with effect from 1 January 1999. Similarly , there is a consensus to the effect that the legal continuity of contracts must not be affected by the introduction of the single currency , and that is as it should be. After all , within the framework of an internationally applicable monetary law , we should recall that every State has the sovereign right to define the characteristics of its currency and to define and vary the rate at which the old currency is converted to the new. Well , the European regulations now being finalized should be a law of that type , so that the universally recognized principle of monetary nominalism will apply.With regard to contracts that are subject to the law of a third country , the introduction of the euro must , once again , not be seen as a challenge to the equilibrium of the contracts
Es besteht aber auch Einmütigkeit darüber , daß die rechtliche Kontinuität von Verträgen durch die Einführung der einheitlichen Währung nicht berührt wird , und das ist gut so. In Zusammenhang mit einem international anzuwendendem Währungsgesetz sei daran erinnert , daß jeder Staat souverän darin ist , die Eigenschaften seiner Währung festzulegen und den Umrechnungskurs von der alten in die neue Währung festzulegen und zu verändern. Die europäische Verordnung , die gerade erarbeitet wird , sollte ein Gesetzestext dieser Art sein. Damit käme der weltweit anerkannte Grundsatz des Währungsnominalismus zum Tragen.Was nun die Verträge angeht , die dem Recht eines Drittstaates unterliegen , so kann die Einführung des Euro auch hier nicht als Infragestellung des Gleichgewichts der Verträge angesehen werden. Insgesamt scheinen die Probleme mit der Kontinuität von Verträgen also weniger gravierend zu sein als ursprünglich angenommen. Es ist jedoch durchaus vorstellbar , daß die Festlegung des rechtlichen Status des Euro eine heikle Angelegenheit ist , zumindest für den Übergangszeitraum
I would like to add very briefly that , as the Committee on Petitions , we need to create an organic system within Parliament for consultation with other Committees , and this will probably be achieved by means of an internal parliamentary regulation. Furthermore , there should never be any conflicts of competences ; rather , we must work together and cooperate.As regards own - initiative reports , I would like to say briefly that perhaps we should amend the Rules of Procedure in this regard too , for the own - initiative reports decided by the Conference of Presidents should certainly reach plenary , having already been processed at Committee level with the appointment of rapporteurs , the drafting of the report , and so forth , and they must not be blocked by any organ. If there has to be a filter , I believe that this should be applied as early as when the proposal to draft such a report is being considered.The third and final point relates to the restructuring of the Committee on Petitions. I am not in favour of nominalism
Darüber hinaus darf es niemals Kompetenzstreitigkeiten geben , sondern wir müssen zusammenarbeiten und kooperieren.Zu den Initiativberichten möchte ich kurz sagen , dass wir diesbezüglich die Geschäftsordnung vermutlich ebenfalls werden ändern müssen , weil die von der Konferenz der Präsidenten beschlossenen Berichte sicher auch dem Plenum vorgelegt werden müssen , nachdem sie durch die Benennung der Berichterstatter , die Ausarbeitung des Berichts usw. bereits ein Verfahren im Ausschuss durchlaufen haben , und dürfen durch kein Organ blockiert werden. Wenn es einen Filter geben muss , so sollte dieser nach meinem Dafürhalten bereits bei der Prüfung der Anträge auf die Ausarbeitung derartiger Berichte zum Tragen kommen.Der dritte und letzte Punkt betrifft die Umgestaltung des Petitionsausschusses. Ich bin nicht für Nominalismus. Wenn der Petitionsausschuss nicht so bleiben soll wie er ist und sich mit anderen Aufgaben befassen soll , muss unbedingt eine Umgestaltung des Sekretariats ins Auge gefasst werden , anders wird das nicht möglich sein. Wenn das Sekretariat bleibt wie es ist , mit dieser Struktur , kann sich der Petitionsausschuss nicht mit anderem befassen.Haben Sie vielen Dank für Ihre Hinweise und Vorschläge
