Mr President , I will use this additional time you have granted me to welcome Commissioner Pinheiro and to welcome the decision of the Commission which , in Solomonic fashion , as we are dealing with Asia and Latin America , thought of asking the Commissioner responsible for Africa to reply
Herr Präsident , ich werde diese zusätzliche Zeit , die Sie mir zugestanden haben nutzen , um Herrn Kommissar Pinheiro und den Beschluß der Kommission zu begrüßen , die in salomonischer Art und Weise sich dafür entschieden hat , in der Angelegenheit Asien und Lateinamerika den zuständigen Kommissar für Afrika zu Rate zu ziehen
I want to talk about the judgment , by the Court of Justice , on the Stability and Growth Pact. I was among those who criticised the Commission for having brought the matter before the Court , because the Stability Pact is a policy matter and is not governed by the courts. However , in that respect I have to admit that the judges at the Luxembourg Court have resisted the temptation to meddle in the Union’s economic policy. In a Solomonic judgment , the Court has reminded the Commission that the Ecofin Council does indeed have the power of assessment , but that the Ecofin Council does not necessarily have to follow the Commission’s recommendations.At the same time , however , Ministers have been called to order for failing to observe the rules which they themselves laid down. Nevertheless , as far as the pact is concerned , the most important point in the Court’s judgment remains the confirmation of the Commission’s sole right of initiative
Aber diesbezüglich muss ich anerkennen , dass die Luxemburger Richter der Versuchung widerstanden haben , sich in die Wirtschaftspolitik der Union einzumischen. Durch ein salomonisches Urteil haben sie die Kommission darauf hingewiesen , dass der Ecofin - Rat eine Bewertungsvollmacht besitzt , dass er aber nicht notwendigerweise den Empfehlungen der Kommission folgen muss.Gleichzeitig werden die Minister dafür gerügt , dass sie die Regeln , die sie sich selbst gegeben haben , nicht eingehalten haben. Was jedoch den Pakt betrifft , so ist und bleibt der wichtigste Punkt des Gerichtsurteils die Bestätigung des alleinigen Initiativrechts der Kommission. So kann der Rat die Regeln – ich zitiere „später nicht ohne erneute Empfehlung der Kommission ändern“. Die Kommission wird also in ihrem Initiativrecht gestärkt , aber zu jedem Recht , Herr Präsident Prodi , gehören auch Pflichten. Die Kommission hat nun also die Pflicht , Vorschläge zu unterbreiten , um aus einem „dummen“ Stabilitätspakt einen wirklich intelligenten Pakt zu machen
