Should I say that there are some rumours in circulation , but that in general everything is going terrifically well in the Commission. Or should I say that things are not that great. We both know exactly what the truth is. It is out of the question for us to take this issue of mini - budgets and legal bases , and fight it out at the expense of the NGOs in this sensitive area

The Commission explicitly committed itself , in that interinstitutional agreement , to explain fully today when it presents its annual legislative programme , firstly the choice of legislative instrument for each proposal , and secondly the choice of legal base. There are some indications on the legal bases , in these lengthy , somewhat impenetrable annexes , but no reference whatsoever to the choice of legislative instrument. It cannot be that , a few months after the signing of an interinstitutional agreement on better law - making , the Commission fails , at the first hurdle , to honour the promises made in that agreement. It bodes extremely ill for the improvement of law - making for that to be the case.This is a terrifically important moment in the political and legislative cycle in the European Union. It is the moment when the European Commission exercises its supreme privilege and prerogative – namely the monopoly right of initiative
Die Kommission verpflichtete sich in dieser interinstitutionellen Vereinbarung explizit , bei der Vorlage des jährlichen Legislativprogramms eingehend zu erläutern , erstens welches legislative Instrument und zweitens welche Rechtsgrundlage sie für jeden Vorschlag vorsieht. Zwar enthalten diese weitschweifigen und nur schwer durchschaubaren Anhänge Hinweise auf die jeweiligen Rechtsgrundlagen , aber einen Verweis auf das entsprechende legislative Instrument sucht man vergebens. Es kann nicht angehen , dass die Kommission nur wenige Monate nach Unterzeichnung einer interinstitutionellen Vereinbarung über bessere Rechtsetzung bereits an der ersten Hürde scheitert und die in dieser Vereinbarung gemachten Zusagen nicht einhält. In dem Falle sehe ich für die Verbesserung der Rechtsetzung recht schwarz.Dies ist ein äußerst bedeutsamer Zeitpunkt im politischen und legislativen Zyklus der Europäischen Union. Es ist der Zeitpunkt , an dem die Europäische Kommission ihr oberstes Privileg und Vorrecht wahrnimmt , und zwar das allein ihr zustehende Initiativrecht
