| How can we justify it to the public if we say that the donor has the right to informed consent , and trade in his/her cells and tissue is not permitted if it is intended for transplants , but all these rights can be disregarded if the purpose is research. We really cannot present that kind of proposal to the public. Amendment No 19 is therefore a good compromise.There are individual speakers who say that Article 152 is not an adequate legal basis for the committee's more far - reaching proposals. I have spoken to many legal experts and my view on this issue is that the legal basis is entirely viable for the more far - reaching proposals that we have put forward , because everything we have proposed concerns not purely ethical issues but ethical issues relating to the health of donors and recipients. In contrast to the issue of anonymity or reconstruction of the cadaver - issues that the Commission has indeed addressed in its proposal - the relevance to public health can be presented in much clearer terms on the issues that we have addressed | Wir können der Öffentlichkeit nicht wirklich einen solchen Vorschlag präsentieren. Ich habe mit vielen Juristen gesprochen , und meine Einschätzung danach ist die , dass die Rechtsgrundlage für die weiter gehenden Vorschläge , die wir gemacht haben , durchaus tragfähig ist , weil alles , was wir vorschlagen , nicht rein ethische Fragen betrifft , sondern ethische Fragen , die im Zusammenhang mit Gesundheit von Spender und Empfänger stehen. Im Gegensatz zu dem Thema Anonymität oder Rekonstruktion der Leiche - Themen , die die Kommission in ihrem Vorschlag durchaus aufgegriffen hat - kann man bei den Themen , die wir aufgegriffen haben , den Bezug zur öffentlichen Gesundheit sehr viel besser darstellen.Deswegen bitte ich die Kommission , über ihre zurückhaltende Position zu diesem Thema noch einmal nachzudenken. Wir sollten ein klares Signal an die anderen Institutionen senden und den Bericht des Ausschusses annehmen |
