| Madam President , Mr Commissioner , ladies and gentlemen , I in turn am anxious to thank the rapporteur , Mr Medina Ortega , for his very thorough work and the willingness he has expressed throughout the debates in the Committee on Legal Affairs to take account of the view of the majority of Members of Parliament. I am of course referring to the opinion expressed during at first reading by our Parliament on 12 October 1995.The introduction of the repair clause in the motor industry sector has been at the heart of the debates since this proposal for a directive was put before Parliament. This focus on the motor industry is hardly surprising. The economic stakes associated with vehicles are considerable. It is surely true to say that , after a house , a car represents the largest and most expensive investment for the majority of European consumers. However unsurprising this focus on the motor industry may be , that does not make it any less unfair. Indeed , how , indeed , could we neglect other sectors of European industry equally affected by this harmonization of national legislation , like textiles and clothing , watchmaking , electronics. The fault lies with the repair clause , I am told , but its impact would be less in these sectors.On the subject of this famous clause , which has become the focal point of our discussions , it must be stated that the Commission has , in its modified proposal , linked up with the position expressed by Parliament at first reading | Frau Präsidentin , Herr Kommissar , sehr verehrte Kolleginnen und Kollegen. Ich möchte mich ebenfalls beim Berichterstatter , Herrn Medina Ortega , für seine sehr detaillierte Arbeit sowie dafür bedanken , daß er während der gesamten Beratungen im Ausschuß für Recht und Bürgerrechte die mehrheitliche Meinung unseres Parlaments berücksichtigt hat. Ich beziehe mich natürlich auf die Stellungnahme , die in erster Lesung vom Parlament am 12. Oktober 1995 abgegeben wurde.Die Einführung der Reparaturklausel in der Automobilindustrie stand im Mittelpunkt der Debatten , seitdem unserem Parlament dieser Vorschlag für eine Richtlinie vorgelegt wurde. Diese Konzentration auf die Automobilindustrie ist nicht verwunderlich. Der wirtschaftliche Einsatz , der mit dem Automobil verbunden ist , ist beträchtlich. Ist das Auto nicht nach dem Haus die wichtigste und kostspieligste Investition für die meisten europäischen Verbraucher. So wenig überraschend eine solche Fokussierung auf den Automobilbereich auch sein mag , so ist sie deshalb nicht weniger ungerecht. Wie konnten wir denn andere europäische Industriebereiche , wie die Textil - und Bekleidungsindustrie , die Uhrenindustrie , die Elektronikindustrie , die in gleichem Maße von der Harmonisierung der nationalen Rechtsvorschriften betroffen sind , vernachlässigen. Sie werden mir sagen , der Fehler liegt bei der Reparaturklausel , deren Auswirkungen auf diese Bereiche geringer wären.Was die vielzitierte Reparaturklausel anbelangt , die zum Mittelpunkt des Interesses bei unseren Diskussionen wurde , so ist festzustellen , daß der Ausschuß für Recht und Bürgerrechte in seinem geänderten Vorschlag die Position einnimmt , die vom Parlament in erster Lesung vertreten wurde. Das kommt so selten vor , daß es hervorzuheben ist und unsere ganz Aufmerksamkeit finden muß |
