| In any event it would be in the Community's interests to link the two systems. That is to say that had the Madrid Agreement not been amended by the 1995 Madrid Protocol , anyone holding a Community mark would have had to go to the national system and then to the international system , but as a result of the Madrid Protocol , international coverage can be obtained for the mark by going through the Community office rather than on some peregrination. At the present time all the Member States of the European Community are party to the Madrid Protocol and are of course governed by the Rule of Community Law and they are not the only ones ; in addition many more countries who are hoping to join the European Union or who form part of the European economic area have also acceded to the Madrid Protocol. This produces very positive results which will be exceptionally helpful to the development of the Community mark. The approval mechanism might appear a little complicated since on the one hand we have the proposal for a Council regulation amending Regulation 4094 to make it possible to interlink the two systems - the Community system and the international system - and on the other hand the Council decision approving Community accession | Im Augenblick sind alle Mitgliedstaaten der Europäischen Union dem Protokoll von Madrid beigetreten und damit der gemeinschaftlichen Regelung unterworfen ; außerdem gilt das Protokoll von Madrid auch für die Länder , die der Europäischen Union beitreten wollen oder dem europäischen Wirtschaftsraum angehören. Dieses Protokoll hat also sehr positive Konsequenzen , die die Entwicklung der Gemeinschaftsmarke in besonderer Weise begünstigen werden. Der Genehmigungsmechanismus mag vielleicht etwas kompliziert erscheinen , denn einerseits haben wir einen Verordnungsvorschlag des Rates zur Änderung der Verordnung 40/94 , um die beiden Systeme , das gemeinschaftliche und das internationale , miteinander verbinden zu können , und andererseits die Entscheidung des Rates über die Genehmigung des Beitritts der Europäischen Gemeinschaft. Das heißt also , daß der Rat , daß die Europäische Gemeinschaft dem Protokoll von Madrid beitritt , und daß dann als Folge dieses Beitritts das geltende Gemeinschaftsrecht durch eine Verordnung geändert wird , um die ganze Situation zu klären. Es gibt nur ein kleines Problem hinsichtlich der Sprachenregelung , denn die Amtssprachen der Gemeinschaft , die Sprachen , die im Harmonisierungsamt für den Binnenmarkt in Alicante benutzt werden , sind zahlreicher sind als diejenigen , die das Abkommen von Madrid vorsieht. Das Abkommen von Madrid betrachtet nur Englisch und Französisch als zugelassene Sprachen. Dies bringt einige kleinere Probleme technischer Art mit sich , die aber auf keinen Fall die Harmonisierung beeinträchtigen werden |
