Mr President , unfortunately , I only have an unreasonably short amount of time to present my opinion of the legal basis , and that of the Committee on Legal Affairs and the Internal Market. This is not about having some kind of hidebound discussion for legal experts , an exercise in legal hair splitting as it were , but concerns an eminently political issue , namely that of competences and the demarcation thereof.Even a court of law does not simply apply law on its own in such cases. It creates and drafts law , and further develops it. As co - legislators , we would do well to take part in this drafting process
Herr Präsident. Leider verfüge ich nur über eine unzumutbar kurze Zeit , um meine Auffassung und die des Ausschusses für Recht und Binnenmarkt zur Rechtsgrundlage darzulegen. Dabei handelt es sich nicht etwa um eine engherzige juristische Fachdiskussion , gewissermaßen um eine rechtliche Haarspalterei , sondern um eine eminent politische Frage , nämlich um die Frage nach den Zuständigkeiten und deren Abgrenzung.Auch ein Gerichtshof wendet in solchen Fällen nicht einfach nur Recht an. Er schöpft , er gestaltet Recht , und er entwickelt es weiter. Uns als Mitgesetzgeber stünde es gut an , an dieser Gestaltung mitzuwirken. Und das tun wir , indem wir eine Abgrenzung , eine Grenzziehung von uns aus vornehmen
Madam President , notwithstanding everything the Council of Ministers and the European Commission have said , the inescapable fact is that in this area the European Union is hidebound by bureaucracy. There is no openness , the instruments of policy are ineffective , what we have are recommendations , resolutions , as we have just seen. Things over which a popularly elected body such as ourselves cannot exercise any scrutiny.Of course we realize , Madam President , that the reason for this is the structure of the third pillar as enshrined in the Maastricht Treaty , the structure of decision - making. But for my own part I must say that a whole lot of policy areas are not getting started early enough and fast enough

Allen guten Worten des Ministerrates wie auch der Europäischen Kommission zum Trotz müssen wir feststellen - es führt kein Weg daran vorbei - , daß die Europäische Union auf diesem Gebiet eine Art von Beamtenstaat ist. Es gibt keine Offenheit , die Mittel der Politik taugen nichts , es geht um Empfehlungen , Entschließungen , wie soeben bereits gesagt wurde ; alles Dinge , die für eine Volksvertretung , wie wir es sind , nicht zu kontrollieren sind.Frau Präsidentin , selbstverständlich ist uns bewußt , daß dies an der Struktur , der Struktur des dritten Pfeilers liegt , wie er im Vertrag von Maastricht verankert ist , der Beschlußfassungsstruktur. Ich möchte aber auch von meiner Seite aus feststellen , daß eine große Zahl von Politikbereichen nicht rechtzeitig und nicht rasch genug vorankommen
This report does not actually reflect Mrs Roth's personal opinions. Rather than setting out her own opinions , which are - if I may say so - quite extreme in some ways , she has made a great effort to give a comprehensive overview of human rights in the European Union. That is why I am pleasantly surprised , and I would add that the annual report on human rights in the EU must not - as has unfortunately happened in the past - be the cause of a clash of views between different factions. I hope that this year , Parliament will manage to rise above such unproductive argument , because there are certainly other ways of measuring the numerical strength of the various groups and factions , rather than by examining and discussing human rights.I wish to make it clear at this point that I shall be voting in favour of the report , even though I cannot go along with certain parts of it ; I do , however , agree with its overall thrust and am convinced that it is useful and necessary for progress in Europe. To stress the need to overcome hidebound attitudes , I spoke out several times in committee against the rapporteur's draft , and I believe that not even she herself agrees entirely with all the paragraphs of the report
Der vorliegende Bericht gibt nämlich nicht den persönlichen Standpunkt von Frau Claudia Roth wieder. Die Berichterstatterin hat also nicht ihre - mit Verlaub gesagt - zum Teil radikalen Positionen in den Bericht aufgenommen , sondern sie war in hohem Maße darum bemüht , die Lage der Menschenrechte in der Europäischen Union in einem Gesamtbild darzustellen. Aus diesem Grunde bin ich angenehm überrascht , und ich möchte noch hinzufügen , daß der jährliche Bericht über die Achtung der Menschenrechte in der Europäischen Union nicht , wie es in der Vergangenheit leider der Fall war , eine Gelegenheit für parteipolitische Auseinandersetzungen und nicht ein Dokument darstellen kann und darf , bei dem sich zwei Fronten gegenüberstehen. Ich hoffe , daß das Europäische Parlament in diesem Jahr ein solches Schema , das nichts einbringt , überwinden wird , denn es ist zweifellos nicht der Sinn , über Menschenrechte zu sprechen und sich damit zu befassen , um dabei zu messen , wie stark die jeweiligen Fraktionen und politischen Lager zahlenmäßig sind.Ich möchte hier mitteilen , daß ich für den Bericht stimmen werde , wenngleich ich mit einigen darin enthaltenen Punkten nicht einverstanden bin ; ich bin allerdings mit der allgemeinen Struktur des Berichts einverstanden und ich bin überzeugt , daß dieser Bericht nützlich und notwendig ist , wenn Europa weiter vorangebracht werden soll
