As Commissioner Liikanen has already said , this is an amendment to the twenty - third amendment of Directive 76/769 relating to restrictions on the marketing and use of certain dangerous substances and preparations . The proposal , based on Article 95 of the Treaty , has two main objectives : to safeguard the internal market by introducing harmonised provisions on the marketing and use of the above - mentioned substances and to achieve a high level of protection for human health and the environment.It is appropriate to point out that we are talking about 25 substances in particular , 14 of which are classified as category 2 carcinogens , such as some cobalt salts , cadmium , benzopyrene , azoic colouring agents and so on ; three of these are classified as mutagens and eight as toxic to reproduction. For example , it has been established that cobalt causes carcinogenic effects in laboratory animals and in human beings , particularly lung cancer and myocardial tissue tumours ; cadmium powders , for their part , can cause testicular cancer in addition to lung cancer. As can therefore be inferred from these brief examples , we are dealing with highly dangerous substances.During the last year and a half to two years of work , Parliament adopted at first reading , in February 2002 , two amendments which the Council , in June 2003 , partly accepted by adopting its common position
Es handelt sich , wie der Herr Kommissar vorwegnahm , um eine Änderung zur dreiundzwanzigsten Änderung der Richtlinie 76/769/EWG des Rates für Beschränkungen des Inverkehrbringens und der Verwendung gewisser gefährlicher Stoffe und Zubereitungen , d. h. also jener Stoffe , die als krebserzeugend , erbgutverändernd bzw. fortpflanzungsgefährdend eingestuft werden. Mit dem Vorschlag , der auf Artikel 95 des EG - Vertrags gestützt wird , werden zwei Hauptziele verfolgt : zum einen der Schutz des Binnenmarkts durch Einführung einheitlicher Vorschriften über das Inverkehrbringen und die Verwendung der genannten Stoffe und zum anderen die Gewährleistung eines hohen Niveaus für den Schutz der menschlichen Gesundheit und der Umwelt.Es sei in Erinnerung gebracht , dass es speziell um 25 Stoffe geht , von denen 14 als krebserregend der Kategorie 2 eingestuft wurden , wie z. B. einige Cobaltsalze , Cadmium , Benzopyren , Azofarbstoffe usw. , drei als erbgutverändernd und acht als fortpflanzungsgefährdend. Es wurde zum Beispiel festgestellt , dass Cobalt krebserregende Wirkung bei Versuchstieren und beim Menschen hat und insbesondere Lungenkrebs und Tumore am Herzmuskelgewebe hervorruft ; Cadmiumstaub kann außer zu Lungenkrebs auch zu Hodenkrebs führen. This is actually the twenty - third amendment of Council Directive 76/769 relating to restrictions on the marketing of substances classified as carcinogens , mutagens or substances toxic to reproduction - a directive , therefore , which seeks to protect consumers health and to harmonise the common market in products with the same characteristics.As stated in Annex I , the proposal relates to 25 new substances classified as category 2 , 14 of which are considered to be carcinogens - cobalt salts , some cadmium salts , benzopyrene and some azoic dyes which have been recorded for years in literature as having carcinogenic properties have , at last , been included - three of which are considered to be mutagens and eight of which are considered to be toxic to reproduction.As well as substances such as these , the ban is extended by the Commission to preparations , that is to mixtures or solutions of these substances. The Group of the Greens/European Free Alliance , particularly Mrs Schörling and a number of other Members , would like to see the ban extended to the marketing of products and articles containing these substances , such as toys , textiles or flooring , too.I would stress that I am opposed to the idea of extending the ban to products as well. Consider the damage it would cause , not just in economic , commercial and industrial terms but the psychological damage too , should people learn that one of these substances - an azoic dye , for example - is present in an elegant tie , whereas , in actual fact , the carcinogenic substances are never released from that tie and the health of the person wearing it is therefore never placed at risk.I will therefore confirm our position. We are opposed to Amendment No 1 , tabled by Mrs Schörling , which was only endorsed by the Committee on the Environment by a very small majority and which states that the Commission should extend the ban on substances classified as carcinogenic , mutagenic or toxic to reproduction
Es geht in der Tat um die dreiundzwanzigste Änderung der Richtlinie 76/769/EWG des Rates betreffend das Verbot des Inverkehrbringens und der Verwendung krebserzeugender , erbgutverändernder bzw. fortpflanzungsgefährdender Stoffe - einer Richtlinie also , die auf die Verbesserung des Gesundheitsschutzes der Verbraucher und die Harmonisierung des Gemeinsamen Marktes für Produkte mit den gleichen Merkmalen abzielt.Der Vorschlag betrifft , wie in Anhang I der Richtlinie angeführt , insgesamt 25 Stoffe der Kategorie 2 , von denen 14 als krebserregend - endlich wurden die Cobaltsalze , einige Cadmiumsalze , Benzopyren und einige Azofarbstoffe aufgenommen , deren krebserzeugende Wirkung seit Jahren in der Literatur bekannt ist - , 3 Stoffe als erbgutverändernd und 8 Stoffe als fortpflanzungsgefährdend eingestuft wurden.Neben den Stoffen an sich wurde das Verbot von der Kommission auch auf die Zubereitungen , d. h. auf die Gemische oder Lösungen dieser Stoffe , ausgedehnt. Die Fraktion der Grünen/Freie Europäische Allianz , insbesondere Frau Schörling und einige andere Kollegen , wollten das Verbot des Inverkehrbringens auch auf diese Stoffe enthaltende Produkte und Waren wie Spielzeug , Textilien oder Fußbodenbeläge ausweiten.Ich möchte betonen , dass ich gegen eine Ausweitung des Verbots auf die Produkte bin. Stellen Sie sich nur vor , welcher Schaden nicht nur in wirtschaftlicher , kommerzieller und industrieller , sondern auch in psychologischer Hinsicht angerichtet würde , wenn man vom Vorhandensein eines dieser Stoffe , beispielsweise eines Azofarbstoffes , in einer von elegant gekleideten Männern getragenen Krawatte erführe , wo doch die krebserzeugenden Stoffe von dieser Krawatte in Wahrheit niemals freigesetzt werden und somit auch das menschliche Leben nicht gefährden.Ich bekräftige daher unseren Standpunkt. Wir lehnen den von Frau Schörling eingereichten Änderungsantrag 1 ab , der im Ausschuss lediglich mit einer geringfügigen Mehrheit angenommen wurde und wonach die Kommission das Verbot von Stoffen , die als krebserzeugend , erbgutverändernd bzw. fortpflanzungsgefährdend eingestuft sind. auf Produkte ausweiten. sollte'. Ebenso lehnen wir den ersten Teil , d. h. die ersten sieben Zeilen , von Änderungsantrag 2 ab , wo wiederholt wird , dass .das Verbot auf die Produkte
